About These Terms

These Terms and Conditions govern your access to and use of the FCODE website. By accessing or using this website, you agree to use it in accordance with these terms and applicable law.

These website terms do not replace a separate proposal, service agreement, statement of work or contract entered into between FCODE and a client.

About FCODE

FCODE provides software-related services that may include web development, SaaS development, custom software, UI/UX design, backend and API development, cloud deployment, maintenance and technical consulting.

Information presented on this website is general and does not automatically create a client relationship, contractual obligation or guarantee of service availability.

Permitted Use of the Website

You may use this website to learn about FCODE, review services and projects, read published content and contact us about a potential project.

You must not:

  • Use the website for unlawful or fraudulent purposes.
  • Attempt to gain unauthorized access to the website, server, accounts or related systems.
  • Introduce malware, harmful code, automated attacks or disruptive requests.
  • Scrape, copy or extract website content through abusive automated methods.
  • Misrepresent your identity or submit false project information.
  • Interfere with the website's availability, security or normal operation.

Information and Website Content

FCODE aims to keep website information accurate and useful. However, content may be updated, corrected or removed without prior notice.

Service descriptions, project examples, technology references, articles and estimates shown on the website are provided for general information. They do not constitute a binding offer unless confirmed in a separate written agreement.

Project Requests and Proposals

Submitting a contact form or sending a message does not guarantee that FCODE will accept or begin a project.

Before work begins, the parties may agree in writing on matters such as:

  • Project scope and required functionality.
  • Deliverables and development phases.
  • Estimated timeline and milestones.
  • Pricing and payment schedule.
  • Client responsibilities and required materials.
  • Testing, approval and change-request procedures.
  • Hosting, maintenance and post-launch support.
  • Ownership and licensing of project materials.

Where a separate agreement exists, that agreement will govern the project and will take priority over these general website terms if there is a conflict.

Estimates and Pricing

Any price, timeline or effort estimate discussed before a detailed project review is preliminary.

Final pricing may depend on scope, complexity, integrations, content, design requirements, infrastructure, third-party services and requested delivery dates.

Pricing becomes binding only when confirmed through an accepted proposal, contract or other written agreement.

Client Responsibilities

For an agreed project, the client may be responsible for providing accurate requirements, feedback, approvals, branding materials, content, credentials and access to third-party systems within reasonable timeframes.

Delays in providing required information or approvals may affect the delivery schedule and project cost.

The client is responsible for ensuring that materials supplied to FCODE may lawfully be used within the project.

Changes to Project Scope

Requests that fall outside the agreed project scope may require a revised estimate, additional payment or an updated delivery schedule.

Additional work should be confirmed before implementation through an agreed change request, updated proposal or other written approval.

Third-Party Services

Projects or this website may depend on third-party services such as hosting providers, domains, email platforms, payment processors, analytics tools, cloud services, APIs, plugins or software libraries.

Those services are governed by their own terms, pricing, availability and privacy practices. FCODE does not control changes, interruptions or decisions made by independent third-party providers.

Unless otherwise agreed, third-party subscriptions, licences, transaction charges and infrastructure fees are the responsibility of the client.

Intellectual Property

Unless otherwise stated, the FCODE name, website design, original text, graphics, code, branding and other website materials are owned by FCODE or used with permission.

Website content may not be copied, reproduced, sold, republished or distributed for commercial purposes without prior written permission.

Ownership of custom project deliverables, source code, designs, reusable components and third-party materials should be defined in the applicable project agreement.

Portfolio and Project References

FCODE may display publicly available project information, screenshots, general descriptions or technology references in its portfolio only where permitted by the applicable agreement, client approval or lawful public availability.

Confidential information, credentials, private business data and protected source code will not be intentionally published as portfolio content.

Confidential Information

Information shared through a general contact form should not contain passwords, secret keys, payment credentials, sensitive personal data or confidential source code.

Where a project requires confidential information, the parties may establish appropriate confidentiality obligations through a separate agreement.

Website Availability and Security

FCODE may maintain, update, suspend or modify the website when necessary. Continuous or error-free access cannot be guaranteed.

Reasonable steps may be taken to protect the website, but no internet-based service can be guaranteed to be completely secure or permanently available.

This website may contain links to external websites, repositories, social networks or third-party services.

FCODE is not responsible for the availability, security, accuracy, content or policies of external websites.

Limitation of Responsibility

To the extent permitted by applicable law, FCODE is not responsible for losses resulting solely from reliance on general website content, third-party service interruptions, external websites or unauthorized misuse of this website.

Any project-specific warranties, responsibilities, limitations or remedies should be defined in the relevant written service agreement.
